It was 1988 when Dick Wolf came up with the idea for a new TV show which would portray the American criminal justice system in a generally upbeat light. Night & Day was his first thought, but he eventually settled on Law & Order. It followed two detectives (a senior and a junior detective) as they investigated violent crimes. During the second half of the episode, two prosecutors, with the help of the District Attorney, trying to convict the accused.
In 1963, a one-season series called Arrest and Trial aired on Universal Television. McCluggage brought this out to Wolf. Ben Gazzara played a police officer who, in the first half, apprehended a man for robbery, and Chuck Conners played the defense attorney who, in the second half, cleared the offender. This was the weekly formula for the show. When it came time to write a police procedural, Wolf determined that his investigators would likewise be imperfect, but he wanted to take a more realistic approach.

With no pilot, Fox ordered thirteen episodes based solely on the concept. Barry Diller, then the network’s president, reversed the decision. “Fox” was not on his radar, even if he liked the notion of it.
